A significant amount of case law involving capacity assessments and best interests decisions has come to court over the last year, not least as a result of unique issues arising during the Covid-19 pandemic. This session will review what has been learnt and also look ahead to what difference the forthcoming code of practice could make, with a specific focus on:
- Practice points emerging from the body of case law on the subject of the Covid-19 vaccination, mental capacity and best interests.
- The latest learning from case law involving capacity and best interests, including such hot topics as sexual relations and contact.
- The implications of the planned revision of the code of practice for practitioners assessing capacity and making best interests determinations.
